Q. I was charged $1,200 by Debt Solutions of America with the promise that they would lower my house payment. Well they did -- It was $823 a month. Now it's $817. And I'm out $1,200. Is there anything I can to do to recoup my money?

Pamela StaheliA. Pamela, I really hate to hear about cases like yours. With all of the trouble in the housing market, companies like this are popping up more and more. They often call themselves foreclosure rescue or foreclosure relief services, and they promise big things: Lower your mortgage payments, cut them in half, save you thousands of dollars a year.



What they actually do is exactly what you could do on your own, or with the help of a good not-for-profit housing counselor: They help you gather and submit the paperwork needed to complete a loan modification as part of the Making Home Affordable program.



When we received your email, I did a search for the company so I could get in touch and see if we could recoup any of what you lost. What I found, unfortunately, is that this company is already out of business. I did manage to track down Chris Stover, the owner, and he was less than helpful. He said that in order to work with his company, you had to sign a contract that said, essentially, that there are no guarantees.



I know you've acknowledged that you did, in fact, sign this contract. Because the company is out of business -- Stover tells me it "just wasn't a profitable business to be in," although I'm sure you'd disagree -- going after a refund would probably be throwing good money after bad, according to Gerri Detweiler, a credit adviser for Credit.com.



Instead, she thinks you should file a complaint with your state attorney general's office and the Federal Trade Commission (you can do that here). I'd also file a complaint with the Better Business Bureau, which already has a file started on this company, with 10 complaints registered. You can add yours to the list here.



Now, if you're still struggling with your mortgage payments, and it sounds like you are, you should get in touch with a HUD-approved housing counselor. It's completely free, and they'll be able to outline what options are available to you at this point.



Finally, for others out there who are considering one of these services: It's not worth it. There are no quick fixes, and if someone asks you to pay for this kind of counseling service or help with a home modification or a delinquent mortgage, it's more than likely a scam. (As a side note, there are legitimate credit counseling services, which charge a small fee to help you pay down credit card and other debt. If that's what you're looking for, keep your search limited to members of the National Foundation for Credit Counseling.) Whenever you're considering paying for a service of any kind -- debt settlement, credit counseling, even a new cell phone or cable plan -- you should thoroughly research the company, including verifying its rating and accreditation with the BBB.

People blaming the government:


As all of us know that India is a democratic country. Democracy, in simple words, means Government by the people and for the people. This gives every Indian citizen to practice his/her rights and also to select the government by casting their votes. But here the main problem is that majority of people don’t cast their votes and when the government goes into the wrong people’s hands they start blaming the government. This is the main reason for the rising scams, prices and also the reason for the rich becoming richer and poor becoming poorer. May be one day will come when we have to buy a license to take birth in India!


These are the reasons which are favoring corruption in India. The youth has seen it all and wants to change the current situation of India. India is a really good country but as you may have heard that one rotten mango rotten the others in the basket too! The corrupt politicians are those rotten mangoes which are less in quantity but can cause destruction to the majority. This is called as misuse of power and authority. One of my very good friends gave me the idea to write on this topic. So, all credit goes to her for this article. I wish her all the best for life and being a big inspiration in my personal life. We both were discussing on the same topic and decided to work hard and change the face of India. I hope this article makes some difference. One day we, the energetic youth of India, WILL turn India into a golden country!

Help Making Money


It looks like Shep Smith isn't the only person on Fox News that was shamed by Jon Stewart into getting a bit tougher on these Republicans for filibustering the first responders bill. Chris Wallace brought up Stewart's interview with first responders to Jon Kyl, and in response we just got more sorry excuses as to why he still would not support the bill.


Kyl Denies Health Care For 9/11 Rescue Workers Because He Doesn’t Want To ‘Hurry’:


Last week, an incensed Jon Stewart invited 9/11 first responders to the Daily Show to offer their thoughts on this callous behavior. “Disgusted” and “hurt” by their actions, the rescue workers admonished Republicans for using the holiday schedule and Senate process as an excuse to block desperately needed help. Recounting their criticism today, Fox News Sunday host Chris Wallace asked Sen. Jon Kyl (R-AZ) why he couldn’t “find a way to give these heroes peace of mind when it comes to health care.” Ignoring their emotional pleas, Kyl insisted that, while he didn’t want to deny care to those who desperately need it, he just refuses to do so “in a hurry”.


Kyl’s excuses fall flat in the face of fact. Any cries for more time ignore that both the Senate and House version of the Zadroga bill have been available to Kyl since 2009. If a year with the text wasn’t enough, Kyl was free to attend the bill’s June 2010 Senate hearing he insists never happened. Had he shown up, he would’ve learned that the bill is very clear on who is eligible for funding. First responders can pursue compensation established by the Zadroga bill to bolster any coverage already received from the current health fund set up in New York City.


As Jon Stewart pointed out earlier this week as well, after refusing to give these first responders health care, none of these birds should ever be allowed by our media to invoke 9-11 for political purposes ever again. Let's hope this thing gets passed despite the continued obstruction by the likes of Kyl and his fellow shameless Republican cohorts.

WALLACE: Joining us now, two Senate leaders, the number two Democrat, Dick Durbin of Illinois, and his Republican counterpart, Jon Kyl of Arizona.


And, Senators, welcome back to "Fox News Sunday."


KYL: Thank you, Chris.


WALLACE: Senators, before we talk about issues that have gotten a lot of attention, I want to ask you about one that hasn't, and let me begin with you, Senator Kyl.


Will you vote this week for the 9/11 bill that would guarantee health care for the first responders who went to Ground Zero?


KYL: I don't know if that bill is going to come before us, but Dick tells me just a moment ago that he thinks that it will. First question is, is it amendable, or is it a take it or leave it proposition? The bill hasn't been through committee. There are problems with it.


And I think the first thing Republicans will ask is do we have a chance to fix any problems that may exist with it. And it's a lot of money, and so I -- my early response is that I am skeptical about that bill.


WALLACE: Senator Durbin, Republicans in addition to Senator Kyl say - - Republican critics say that you're creating a $7 billion entitlement, and that the way you pay for it is a corporate tax increase.


DURBIN: Chris, I can tell you that Senators Kirsten Gillibrand and Chuck Schumer have been working nonstop for the last several weeks with Republicans to try to find the best way to approach this. These first responders literally risked their lives when they went to Ground Zero. They came from all over the United States. And now many of them are struggling with health problems that are clearly directly related to that experience. To turn our backs on these brave people is the wrong thing to do.


Will it cost money? Yes. Is it the right thing to do? Yes. We've got to find a way to fund it that's acceptable to Republicans and Democrats.


WALLACE: Well, but let me ask you about that, Senator Durbin. If this 9/11 bill is so important, why is it that the Democratic- controlled Senate never held a vote on this bill until the lame duck session and that President Obama, the best we can tell, has never said a word about this bill in public?


DURBIN: I can't tell you where the White House stands. I hope they support it. I will just tell you this. This is like an airport that has a runway closed down. We have aircraft stacked up trying to land. We have bills stacked up over the Senate because of the nonstop filibusters that we faced this year.


I wish we could have done things more efficiently and more directly. But we've lurched from one 30-hour delay to another 30-hour delay to more Senate quorums. This Senate could be much more efficient. It should be. And it should be much more bipartisan than this.


WALLACE: Will this bill pass?


DURBIN: I think this bill will pass, and I do believe that Senators Gillibrand and Schumer are working night and day to make that happen.


WALLACE: Senator Kyl, one of your objections is -- he was blaming you for the filibusters. One of your objections is that Harry Reid put too many items on the agenda in this lame duck session.


I want to play what you said and then how one of the first responders who now has cancer reacted. Let's watch.

KYL: It is impossible to do all of the things that the majority leader laid out without doing -- frankly, without disrespecting the institution and without disrespecting one of the two holiest of holidays for Christians.

WALLACE: Senator, everyone -- everyone -- praises the first responders as heroes. You say you're skeptical about this bill. Why not find a way to give these heroes peace of mind when it comes to health care?


KYL: Well, first of all, they should have peace of mind when it comes to health care. The question is what and how.


And when you try to do it, as you said in your introduction, in a hurry, in the lame duck session, without a hearing, without understanding what the ramifications are and whether we can amend the bill, you're doing it in the worst way.


For example, there's already been a settlement for a lot of these people, a fund that has been set up for them to receive funding. Will the people that are supporting this legislation be able to participate in that fund? Nobody has been able to say. Why $7 billion? What will the requirements for qualification be for the money?


Nobody wants to deny care to people who -- and by the way, these are primarily people who helped to clean up the site in the aftermath of 9/11, and there weren't adequate precautions taken in some cases to deal with potential health issues. And to the extent that they've become ill, they do need to be taken care of.


It's one thing to make an emotional appeal, to say we need to care for somebody who did something good. It's another to do it in a sensible way. And that's all we're asking for. You bring it up in the lame duck session with no opportunity to amend it, and you're probably going to make bad legislation.


WALLACE: Let me move to...


KYL: All of this could have been done earlier, I might add.




While many people may mock the idea of accepting Facebook friend requests from strangers, that might be just what a long-term drug addict needs. An experiment being run in Amsterdam at the moment is exploring the idea.


Dutch branding agency Lemz has set up drug addict Monica with her own Facebook page. As she makes her way around the Dutch city she wears a bright blue jacket bearing text asking people to befriend her on the social network.


What can this possibly achieve? The idea is that by making friends online, Monica will be able to gain self confidence and new interests that will help inspire her to quit her addiction. On the page, Monica says “Don’t be afraid! If you decide to become my friend you will get an interesting peek into my daily life (with a maximum of two posts a day). I will NEVER ask for money or try to visit you in person. The only thing I will ask from you is your online friendship.”


Mark Woerde of Lemz tells us “It all started when a relative of mine started ikgebruik.nl to help junkies find their way to organisations of help. He asked me to help him to promote his site among drugs users. We soon found out that drugs users really wanted to help making this site a big success. Now the site ikgebruik.nl is run by drugs users, sharing their experiences and scaring of potential new users. What really struck me was that these drugs addicts by doing this felt like humans again. Especially when all news channels reported about this group of junkies now helping others.”


Now it’s hoped the Facebook idea will reaffirm Monica’s faith in humanity and that the idea could scale to more addicts in the city. “There are many many people out there who want to help others and you do not need 5000 friends per addict”, Woerde says.

Making Money Cash

The Florida Gators (7-5 overall and 4-4 in SEC play) actually were awarded a bowl bid with a hefty financial payout ($3,100,000) based on past performance.


No other explanation of why Florida is in the Outback Bowl really makes any sense.


Florida will be playing in Tampa against Penn State while South Carolina will face Florida State in the Chick-fil-A Bowl (awarded to the SEC’s No. 5 finisher) and Mississippi State  (who beat Florida straight up and finished a game ahead overall) will play Michigan in the Gator Bowl (meant for the SEC’s No. 6 team).


Who cares that Florida was “less than Florida” this year.  We all know they’ll rebound, and it just seems more like a big game with them than without them.

Who Should be Playing:   Kentucky vs. Syracuse (SEC No. 8 vs. Big East No. 5)


Syracuse finished 2010 with at a better than expected 7-5 mark overall and went 4-3 in Big East play.  Regardless of how good this was it still puts the Orange a step below Pitt who finished (disappointingly) 7-5 overall and 5-2 in conference.


Regardless, Pitt has been shuffled southwards to the BBVA Compass Bowl (meant for the No. 5 Big East team) while the Orange will participate in the first-ever Pinstripe Bowl (hey, that’s played in New York isn’t it?) that is supposed to be awarded to the Big East’s No. 4 finisher.

Evan here. If you are a transactional associate at a top US firm and your name happens to be of Asian origin, especially of Chinese background, then you are probably receiving multiple cold calls per day from recruiters. After all the Asia lateral biglaw markets, especially HK / China are red hot now and it is of course very easy to compile a list of top US firm associates with Asian names.

Keep in mind that there can be very negative consequences in giving control of such an important career move and job search to someone calling you out of the blue (no matter how many times they may call). We often get calls from very well qualified US associates with sad tales of at worst their resume being plastered unauthorized all over China or other Asia markets; or at best only authorized submissions (thankfully) but realizing their recruiter has done little more than emailing their resume to begin with and is unresponsive for weeks.

It is important to note that your resume is a very valuable commodity to recruiters calling you. When you are placed at a law firm, the recruiter who submitted your resume is typically paid (by the law firm) 25 to 30% of your starting base salary. Thus, the recruiters cold-calling you have a big incentive to get a hold of your resume and email it to law firms, with or without your authorization (believe it or not, some biglaw recruiters in Asia are known to be even less ethical than the worst of the lot in the US). Once your resume has been submitted to a law firm, the recruiter who did so “owns” your candidacy there for at least six months. Further, when your resume has been submitted without your authorization, it will take an affidavit from you to the target firm explaining such for the submission to be reversed (and basically that is you explaining to the firm that you did not know you even applied there, which can of course cool off any motivation of that firm to continue to want to interview you, and the unethical recruiter is counting on you to thus not take that route).

We try to think that a lot of recruiters do not take such unethical steps, but please note that even the most well-intentioned recruiters trying to break into the Asia markets are more often than not woefully inexperienced with such lateral placements (and even most of those with some experience have never been more than resume pushers).id="more-49277">

We recommend that you make sure you are represented by a recruiter who is willing and able (has the experience necessary in your target market) to act as your agent, instead of just someone who is only able and / or willing to email your resume to firms. You should be pro-actively looking for an agent (we recommend interviewing prospective agent / recruiters months before you start your search when possible), not simply handing your search over to a headhunter that happens to be calling with the earth shattering news that they know, for example, of firms in China that have openings for Mandarin fluent US associates in cap markets and M&A (almost every top US and UK firm in HK / China has such openings), or that the sky is blue.

The question you should be asking is not whether there are openings and whether you would be very competitive candidate for such spots (yes and yes), but whether the person calling you is best suited for representing you.

At the very least, make sure the recruiter cold-calling you can:

a) Provide at minimum 10 references of US associates they have actually placed in your target market in Asia (I could easily provide 50, as 10 is a very small and unimpressive number, but should be a minimum guideline to figure out if the recruiter actually has a history of successfully placing US associates in your target market); and

b) Is able to discuss in great detail each roles you may consider targeting, including details regarding the relevant partners involved (does the recruiter even have a business relationship with the particular partners making the hire), including their personality, practice area, and plans for growth. I usually refer to this as the “3 hour rule”, in that if you get the impression that the recruiter could not talk non-stop about your target market for about 3 hours, then move on to the next recruiter (does not mean you actually have to listen to them for 3 hours).

It can be a lengthy process to find the right fit lateral spot in Asia, especially if you are moving from the US. It is much more complex than simply moving down the street to another big office. Instead you are moving to a much smaller office, smaller group, a place where you will have a lot more responsibilities with clients and where your personality fit with your primary supervising partner will be key (not only for progression at your new firm, but also for the foundation of your career in your target Asian market).

It is also a very exciting move and you deserve to be working with an agent / recruiter (rather than headhunter / recruiter) who is excited about helping you and the firms / partners he is recruiting for in Asia; who is excited to be invested in your career for the long-term; not focused on a recruiting fee (is willing to give advice not corresponding with recruiter being paid if that is the best advice); and who is capable (actual long-term experience with the market and similar lateral moves) of giving you the best advice and guidance.

If unfortunately you have gone down the road already of being represented by a headhunter (instead of an agent) and you need advice, feel free to get in touch with us as well. I never thought that at age 45, I'd celebrate my first Christmas. But nine months after meeting my current partner, I'm all set to do just that.



Being Jewish, I never celebrated the holiday. When I was little, and on behalf of younger relatives today, there were Chanukah presents. But those are small and only given by, or to, close family members. Sure I counted many Christians among my friends and exchanged a few gifts over the years, but one present here and there doesn't require much strategy.There are non-Christians who celebrate the holiday with a tree and presents, just for fun, and many who've pooh poohed the idea that Christmas is just for Christians. They say that putting up a tree and opening presents is for everyone, regardless of religion. I beg to differ. A holiday should mean something. Encouraging an empty observance feels just that to me: empty and vaguely insulting to those for whom Christmas has meaning.



I won't get into how it feels to be on the sidelines of the holiday season (although it's a lot worse than getting picked last in gym class), and I won't get into how having a birthday in December adds to the misery of not participating in the dominant event (but the former is always overshadowed by the latter, something you don't even celebrate). WalletPop is a personal finance site after all.



All of the above is emotional, not financial. But as I've recently discovered, the two are inseparable when it comes to Christmas.



This year, I am seriously involved with a man who celebrates Christmas. He has a large family and three children, all of whom eagerly plan for the holiday. There are parties, dinners, wish lists, letters to Santa and church services, and I am lucky to be included in all of it. Better yet, for the first time in my life, it doesn't feel false.



But it's also humbling and I've done pretty much everything wrong when it comes to shopping. It's a humiliating thing for a retail reporter and contributor to a personal finance site to confess, but there's an end of the year urge to purge, or er... splurge. Let my mistakes be a lesson, to me and anyone else in a similar position.



1. I Didn't Budget. Yes, I write for a personal finance site, and sure, I'm considered financially savvy, but they say doctors make the worst patients. The same apparently applies to finance writers.



I thought, "There's just these few people. How much trouble could I get in?" Plenty as it turns out, as I struggle not to give in to every urge. "Look, these fleecy pajama pants are perfect for ______," even though I'd already gotten her two presents and would have to buy one more for her older sister in the interest of fairness. Had I made a budget, this would have gone down quite differently.



2. I Didn't Make a List, for them or me. I made a mental list, but not having something solid for reference has me waffling at the store, and this indecision is leading to over-buying (see mistake number 1) and not writing down things that I want, which means I'll likely ponder returning a gift and risk hurting someone's feelings or hanging on to dud gifts. I'm used to buying myself the things I want or need; it would have been nice to receive them as gifts instead.




Consumerist Budget Spreadsheet Balances Your Money, Encourages Your Nest Egg





The saving-savvy folks at The Consumerist blog have put together a template Excel spreadsheet for managing personal finances. It's the kind of thing you always say you're going to do, but they went ahead and did it for you, and it's free.

It's not a new thing, but Consumerist's budget spreadsheet, crafted during the days the site was one of our blog network brethren, has come back, after being lost to the vagaries of server maintenance. The site has instructions on setting it up, including tips on thinking through your monthly expenses and advice on how much you should plan on socking away for a rainy day, retirement, and other expenses.


Maybe you use Mint or another automated spending/saving tracker instead—but then again, maybe those tools are so automatic that you don't get a good look at your real money situation.

Q. I was charged $1,200 by Debt Solutions of America with the promise that they would lower my house payment. Well they did -- It was $823 a month. Now it's $817. And I'm out $1,200. Is there anything I can to do to recoup my money?

Pamela StaheliA. Pamela, I really hate to hear about cases like yours. With all of the trouble in the housing market, companies like this are popping up more and more. They often call themselves foreclosure rescue or foreclosure relief services, and they promise big things: Lower your mortgage payments, cut them in half, save you thousands of dollars a year.



What they actually do is exactly what you could do on your own, or with the help of a good not-for-profit housing counselor: They help you gather and submit the paperwork needed to complete a loan modification as part of the Making Home Affordable program.



When we received your email, I did a search for the company so I could get in touch and see if we could recoup any of what you lost. What I found, unfortunately, is that this company is already out of business. I did manage to track down Chris Stover, the owner, and he was less than helpful. He said that in order to work with his company, you had to sign a contract that said, essentially, that there are no guarantees.



I know you've acknowledged that you did, in fact, sign this contract. Because the company is out of business -- Stover tells me it "just wasn't a profitable business to be in," although I'm sure you'd disagree -- going after a refund would probably be throwing good money after bad, according to Gerri Detweiler, a credit adviser for Credit.com.



Instead, she thinks you should file a complaint with your state attorney general's office and the Federal Trade Commission (you can do that here). I'd also file a complaint with the Better Business Bureau, which already has a file started on this company, with 10 complaints registered. You can add yours to the list here.



Now, if you're still struggling with your mortgage payments, and it sounds like you are, you should get in touch with a HUD-approved housing counselor. It's completely free, and they'll be able to outline what options are available to you at this point.



Finally, for others out there who are considering one of these services: It's not worth it. There are no quick fixes, and if someone asks you to pay for this kind of counseling service or help with a home modification or a delinquent mortgage, it's more than likely a scam. (As a side note, there are legitimate credit counseling services, which charge a small fee to help you pay down credit card and other debt. If that's what you're looking for, keep your search limited to members of the National Foundation for Credit Counseling.) Whenever you're considering paying for a service of any kind -- debt settlement, credit counseling, even a new cell phone or cable plan -- you should thoroughly research the company, including verifying its rating and accreditation with the BBB.

The latest episode was the disappearance of some $200 million in the run up to the 2010 Commonwealth Games in October and new information about a $400 million misappropriation some years ago during allocation of cellular telephone licenses. A particularly painful recent revelation was the allocation of heavily subsidized apartments in a prime area of Mumbai to senior military figures, bureaucrats and politicians instead of the war widows and war wounded for whom they were meant as a grateful nation’s thanks.


A crucial leadership meeting today of India’s venerable Congress Party, which heads the current national coalition government, failed to make corruption a main driver of its political agenda. Congress leaders blamed high level figures in the opposition parties for some of the corruption cases highlighted by the media, thus making corruption a political issue instead of a national scandal cutting across Party lines.


Prime Minister Manmohan Singh, who is widely admired for his personal incorruptibility, and Congress President Sonia Gandhi fueled a sense of helplessness at the impunity of the corrupt when they denounced this malevolence but remained silent about allegations against top Congress politicians and leaders of coalition allies.


Corruption is thought to be embedded deeply at every level, high or low, of every institution of national democracy, including the judiciary, police, tax administration, top administrative officials and politicians. Indian laws disallow investigation or prosecution of politicians without parliament’s permission and of middle and senior bureaucrats without permission from the cabinet of ministers.


There is no institution beyond the control of government or bureaucracy with independent investigative powers and the authority to prosecute politicians or officials. Although draconian laws exist to prevent and punish the corrupt, they are rarely applied and have failed as deterrents.


Obama’s visit and thoughtful words seem to have opened Indian minds to the extraordinary potential of their country. For the first time the leader of the Western world is offering India a seat at the top economic and security tables as a partner. China sits at the top tables because it is feared and its intentions are suspect. India is being asked as a friend.


Suddenly, previous US rhetoric about India’s valued role in world affairs has changed into genuine belief in her ability to help create a more equitable, secure and people-friendly world order. This has jolted Indians out of resignation to being exploited by institutionalized corruption in all corridors of power.


In general, India is dynamic, creative and youthful compared to Western nations, China and Japan. There is energy and excitement about economic growth and making money. But Obama’s visit heightened realization that corruption is a greater enemy of better lives for Indians than poverty and other material shortages.


Disappointment is growing because of recognition that the people cannot trust any institution to impartially uncover and punish the corrupt. The discovery that some senior army generals were involved in Mumbai’s real estate scandal has caused consternation because the army was widely admired for being incorruptible.


A feeling of helplessness is rising because there seem to be no workable solutions, although politicians rail against corruption across Party lines. It turns out that everybody is naked because Sonia Gandhi and Manmohan Singh, both known for their probity, are reluctant to aggressively implement anti-corruption drives within their own Party while making shrill accusations against opposition figures. They fear to open a Pandora’s Box capable of bringing down the government by causing severe losses for the Congress and its allies in elections at the State and local levels.


Even the media is no longer trusted as an honest filter between the powerful and the people. This is mainly because major newspapers and TV channels do not clearly differentiate sponsored news and analysis from genuine reporting.


Transparency international ranks India at 87th place in its index of corrupt countries. There is little hope that things will change dramatically for the better soon.
